Having a baby is one of the best feelings in the world. But unfortunately, there are many couples out there with fertility problems. They can’t conceive a baby naturally. But they do not need to give up on their dream of becoming parents as there are many different ways available.
One of the most common ones is surrogacy, and it has been used for a very long time. Compared to all the other processes, the success rate of this treatment is far more. If you are planning for a surrogacy treatment, then you need to know these details.
What is surrogacy?
Surrogacy is a process that is considered ART (Assisted Reproductive Process). This is a legal arrangement, where a surrogate mother carries the baby for 9 months till birth for intended parents with donated or parent’s eggs/ sperms. This is mostly used when a couple is not able to conceive a child naturally. Apart from that, same-sex couples, single fathers, or mothers can also take the help of this process. There are mainly two types of surrogacy available such as traditional surrogacy and gestational surrogacy. What is the surrogacy bill?
According to the surrogacy bill, the surrogate mother needs to be a close relative of the intended parents. This bill was made to ensure the effective regulation of national and state-level surrogacy boards. It allows the altruistic surrogacy for all the infertile males between 26-55 years and females between 23-50 years. If the surrogate mother does not take any compensation for the whole process, then it is called Altruistic surrogacy. Also, Indian couples need to be in a legally married relationship for more than 5 years for this surrogacy. Some important features of this bill include:
- The surrogate mother needs to be a close relative of the intended parents and mother of at least 1 child
- She needs to be between the age of 25-35 and not having any history of surrogacy
- The surrogate mothers need to be mentally and physically fit
How to make the surrogacy bill inclusive?
According to the bill, the intended parents need to be married Indian couple. But there is no mention of Non-Resident Indian (NRI) couples who are coming back to Indian to have a baby. Couples can only do altruistic surrogacy in this bill, which is a very serious problem for all the women who lend their womb for the surrogacy process to earn money. They are doing a great job in society by helping others but also they put their life at risk. According to the bill, the surrogacy treatment process needs to be treated as a profession. Those who are lending wombs for the process should be paid properly and need to have a medical check along with insurance. In the case of single parents and LGBTQI, surrogacy is allowed as it is the only way for them to have a baby.
